How a Case is Presented: Rights Through the Court Process

There are many steps involved in the process of prosecuting a crime, whether it is a misdemeanor or a felony.  A misdemeanor is a crime where the penalty is a year or less incarceration in County Jail, a $1,000 fine, or both fine and imprisonment.  A felony is a crime where the penalty is incarceration in the State Prison, or a fine in excess of $1000, or both fine and imprisonment.  The District Attorney’s Office represent the People of the State of California in prosecuting both misdemeanor and felony crimes committed in Orange County.The following is a step-by-step guide to the prosecution of both misdemeanors and felonies in the adult and juvenile justice system.
