Rights of Victims Who May Have Been Exposed to AIDS-related Conditions

A. Health and Safety Code § 121050: Legislative purpose.

B. Health and Safety Code § 121055: Right to request court to order AIDS test of defendant and receive results in certain sex offense cases (Penal Code sections 261, 261.5, 262, 266b, 266c, 286, 288 or 288a).

C. Health and Safety Code § 121060: Right to request court to order AIDS test of defendant and receive results in cases where the defendant may have transferred bodily fluid capable of transmitting the disease to police officers, firefighters, or emergency personnel.

D. Penal Code § 1202.1: Right to mandatory AIDS testing and receive results of any adult defendant or juvenile offender convicted of certain specified sex crimes within 180 days of the conviction.

E. Penal Code § 1524.1: Right to request court to order AIDS test of defendant and receive results in any criminal case where bodily fluid capable of transmitting HIV has been transferred.
