FACTS OF THE CASE: The defendant is accused of killing his girlfriends 8-month-old son, whom she left in his care. They had been dating for three months when this occurred. The babys mother left the house at 9:30 a.m. and came home at 1 p.m., and Hernandez is accused of leaving immediately to run errands. When the mother later tried to wake the baby, the baby was unresponsive. Emergency workers and doctors could not revive the baby. There had been two pictures of the defendant in the home and the pictures were missing. The baby suffered five broken ribs, a torn heart, a large bruise and symptoms of a shaken baby.
CIRCUMSTANCES OF DISAPPEARANCE/LAST SEEN: Hernandez abruptly left their Santa Ana home and has not returned.
