Q: I received a bad check, or a check that bounced. Can the DA help?
Q: I received a copy of an insurance bill in the mail and believe that there is some sort of fraud. I did not receive the treatment described in the bill. What should I do?
Q: I received a copy of the billing my medical provider sent to my boss' WC insurance carrier, and they are billing for services I did not receive. What should I do?
Q: I think I have been cheated by a contractor, tradesman, shopkeeper, or other person who provides labor or services. Can the DA’s office help me?
Q: I think that I am suspected of abusing my child, but I am not doing anything. My ex-spouse is telling people I hit the baby, but I don’t. What do I do?

Q: I received a bad check, or a check that bounced. Can the DA help?
A: District Attorney Tony Rackauckas instituted the Bad Check Restitution Program to assist local merchants with bad check losses. The primary goal of the program is to obtain full restitution for the victim without adding to the financial burden of the criminal justice system.  Merchants in Orange County benefit because they receive restitution without paying any collection fees.  First time bad check offenders are given the opportunity to avoid criminal prosecution by attending a mandatory, eight-hour intervention class, in addition to paying restitution. Q: I received a copy of an insurance bill in the mail and believe that there is some sort of fraud. I did not receive the treatment described in the bill. What should I do?
A: Some dishonest medical providers bill insurance companies for services that were not rendered. If you believe this has happened, you should report this to your insurer and/or your employer. If they believe there is something questionable, they will report to the proper authorities and begin an investigation.
 
Q: I received a copy of the billing my medical provider sent to my boss' WC insurance carrier, and they are billing for services I did not receive. What should I do?
A: Workers' compensation fraud can be committed by a worker, an employer, or a medical provider.  Anyone in the system who makes false statements in order to get benefits or money they don't deserve has committed fraud and could be ordered to pay back the money they received, pay heavy fines and go to State Prison for up to five years.  If you suspect a medical provider has billed for services not given, contact your employer, the employer's insurance carrier, or the State Department of Insurance Fraud Division at 714-712-7600.
 
Q: I think I have been cheated by a contractor, tradesman, shopkeeper, or other person who provides labor or services. Can the DA’s office help me?
A: The DA’s Consumer Protection Unit may be able to help, or they may refer you to an agency that can help you. You should send your complaint in writing to: Orange County District Attorney, Consumer Protection Division, 401 Civic Center Drive West, Santa Ana, CA 92701. Q: I think that I am suspected of abusing my child, but I am not doing anything. My ex-spouse is telling people I hit the baby, but I don’t. What do I do?
A: When someone is accused of abusing a child, it can have lasting and far-reaching negative effects. Seek legal counsel if such allegations are being made, and determine what steps you to take in consultation with the attorney. Each situation is different, and no one solution will work in all cases.
 
Q: I want a divorce. [Or, I want to sue someone. Or, I want to adopt a child.] Can the DA’s Office help me?
A: The District Attorney’s Office cannot provide legal advice or take legal action on your behalf in such situations.  You should consult a private attorney.  If you do not have an attorney, you can call the Lawyer Referral Service which is operated by the Orange County Bar Association at (949) 440-6700.
 
Q: I want a restraining order to keep my [husband/wife, boyfriend/girlfriend, or other person] away from me. Will the DA’s Office do this for me?
A: It depends. If there are no pending criminal charges, you may choose to consult a private attorney. If you do not have an attorney, you can call the Lawyer Referral Service which is operated by the Orange County Bar Association at (949) 440-6700. Also, the Victim/Witness Assistance Program may be able to assist you in obtaining a domestic violence restraining order. Contact the Domestic Violence Assistance Program located at the Lamoreaux Justice Center in the City of Orange. Their phone number is (714) 935-7956. If criminal charges are pending against your husband/wife, etc., the District Attorney’s Office generally requests a criminal protective order pending resolution of the case. Protective orders are granted at the discretion of the court. Oftentimes the District Attorney’s Office will request a criminal protective order as part of a defendant’s sentencing. If you are being abused, you should contact your local police agency to file a report. The police agency may also assist you in obtaining an emergency protective order.
 
Q: I want to find out which prison an inmate is located and when he or she will be released. Whom should I contact?
A: You may contact the California Department of Corrections and Rehibilitation's Prison Inmate Locator at (916) 445-6713.
 
Q: I want to participate in an inmate’s parole hearing. Whom should I contact?
A: Board of Prison Terms at (916) 445-4072 or Victim Services at (916) 327-5933428

Q: I was cited and released by the police. Can you tell me if the DA filed charges on me?
A: Yes. Unless you were cited directly to court for a minor offense or a traffic matter, the District Attorney’s Office will review the police reports and decide whether charges should be filed against you. After that review is complete, we can tell you if charges were filed or if the matter is still pending. Please call the DA’s Office in the judicial district where the crime occurred. For example, if the crime occurred in Buena Park, contact the DA’s Office at the courthouse in Fullerton (North Justice Center).

Central Justice Center:  Santa Ana, Orange, Tustin, and Villa Park.

Harbor Justice Center (Newport Beach Facility):  Aliso Viejo, Costa Mesa, Lake Forest, Laguna Woods, Laguna Beach, Newport Beach, Balboa, Corona Del Mar, Irvine, John Wayne Airport, and Santa Ana Heights.

Harbor Justice Center (Laguna Niguel Facility): Capistrano Beach, Coto de Caza, Dana Point, Ladera Ranch, Laguna Hills, Laguna Niguel, Mission Viejo, Rancho Santa Margarita, San Juan Capistrano, San Clemente, and Trabuco Canyon. (This facility will be closed during construction and its matters may be heard in Newport Beach.)

Juvenile Justice Center:  All communities in Orange County.

North Justice Center:  Anaheim, Brea, Buena Park, Fullerton, La Habra, La Palma, Placentia, and Yorba Linda.

West Justice Center:  Seal Beach, Cypress, Los Alamitos, Garden Grove, Westminster, Huntington Beach, Fountain Valley, Midway City, Rossmoor, and Stanton.

PLEASE NOTE: When you were released, you signed a promise to appear.  To avoid possible additional charges or a warrant for your arrest, YOU MUST APPEAR IN COURT as directed on your citation.
