INMATE WHO KIDNAPPED AND MURDERED TWO YOUNG BOYS AGREES TO CONTINUE PAROLE HEARING TO 2014

SANTA ANA The Board of Parole Hearings (Board), California Department of Corrections and Rehabilitations continued the parole hearing to 2014 for a man convicted of kidnapping and murdering two young boys, ages 12 and 14, in Orange and Los Angeles Counties. Both victims were also sodomized by the inmates co-defendant. Gregory Matthew Miley, 50, is currently being held at California Substance Abuse Treatment Facility in Corcoran, CA. Miley was scheduled for a parole hearing tomorrow, but prior to the hearing conceded that his parole would be denied and stipulated to a 3-year continuance.
Miley was sentenced Nov. 22, 1983, for the Orange County first degree murder conviction to 25 years to life in state prison, to be served consecutive to his sentence for the Los Angeles County conviction for first degree murder. Former Deputy District Attorney Jay Moseley originally prosecuted the Orange County case.
Orange County Deputy District Attorney Matt Lockhart appeared at the prison to oppose Mileys parole.
Kidnap, Sexual Assault, and Murder of Two Boys in Orange and Los Angeles Counties
In the early morning of Feb. 3, 1980, then-18-year-old Miley and serial killer William Bonin, also known as the Freeway Killer, were driving Bonins van in West Hollywood and picked up 14-year-old Charles Miranda by the Starwood Ballroom. They drove several blocks, parked, and then Bonin sodomized Miranda. Miley attempted to sodomize Miranda but was unable to sustain an erection. Bonin and Miley tied Mirandas hands and feet together. Bonin grabbed Mirandas shirt, put it around the victims neck, and began twisting the shirt to suffocate him. Miley took hold of the shirt while Bonin picked up an iron bar, wrapped it in the shirt and twisted it until the victim suffocated to death. Bonin and Miley drove to an alley in downtown Los Angeles and dumped the victims body. They fled the scene and drove to Huntington Beach.
Later that morning, Bonin and Miley spotted 12-year-old James McCabe walking down the street and pulled up to him in the van to engage him in conversation. The victim told the defendants he was on his way to Disneyland. Miley and Bonin then lured him into the van. While Miley drove the van, Bonin sexually assaulted McCabe. Once the van was parked, Bonin and Miley murdered McCabe by holding him down and twisting a shirt around the victims neck until he suffocated to death. They drove to the City of Walnut and dumped the victims body in a dumpster.
On Aug. 22, 1980, Miley admitted to his participation in the sexual assaults and murders of the two victims in a recorded phone conversation with a friend. Miley was arrested while living in Houston, Texas.
Bonin was prosecuted for and convicted of 14 murders. He was sentenced to the death penalty and was executed Feb. 23, 1996, by lethal injection.
Lack of Rehabilitation and Risk to Public Safety
In a 2011 opposition letter, the People state that the inmate
used heroin, PCP, LSD, cocaine, marijuana, alcohol, and valium prior to the life crime. The inmate was engaged in a lifestyle where he brought in young boys to his home for sexual relations.
While incarcerated, Miley has incurred 26 prison rules violations including nine serious violations for threats against an inmate, sexual behavior for attempting to engage in non-consensual sodomy, refusal to report and remain in school, possession of unauthorized medication, renting out property to another inmate, failure to report, failure to comply with grooming standards, and responsibility for counts. This demonstrates that Miley is unable to follow rules, even while incarcerated in a controlled environment.
Miley poses a continued threat to society based on the significant threat to public safety he poses, as evidenced by the circumstances of the murders and the inmates multiple prison rules violations.
